1. Introduction
These Terms of Service (“Terms”) govern your access to and use of Uns (the “Platform”, “we”, “us”, or “our”), a product owned and operated by Takamul Technologies.
By accessing or using the Platform, you agree to be bound by these Terms.
2. Governing Language
These Terms are prepared in both Arabic and English. In the event of any conflict or discrepancy between the two versions, the Arabic version shall prevail and be the legally binding version.
3. Platform Nature
Uns is a technology platform that facilitates the creation and delivery of event invitations.
Uns does not organize, manage, verify, endorse, or take responsibility for any event, invitation, or related activity, including but not limited to event execution, attendance, or outcomes.
4. Eligibility
- You must be at least 18 years of age to use the Platform
- By using the Platform, you represent and warrant that you meet this requirement
5. Accounts
- You are responsible for maintaining the confidentiality and security of your account
- You are responsible for all activities conducted under your account, including but not limited to invitations sent and content created
- You may request account deletion; however, certain data may be retained as required for legal, regulatory, security, or operational purposes
6. User-Generated Content
The Platform enables users to create and distribute content, including but not limited to:
- Event names
- Event images
- Event locations
- Sender names
- Messages and invitation details
You acknowledge and agree that:
- All such content is solely created and controlled by users
- Uns does not verify, validate, endorse, or monitor such content
- Uns does not verify the identity of senders or the authenticity of displayed names
- You are solely responsible for all content you create, upload, or distribute
7. User Responsibilities
You represent and warrant that:
- You have all necessary rights, permissions, and authority to create and share content
- You have obtained consent from recipients prior to sending invitations
- All information provided is accurate, lawful, and not misleading
- You will not impersonate any person, brand, or entity, including but not limited to misrepresenting identity or affiliation
8. Invitations & Delivery
The Platform processes and attempts delivery of invitations through one or more communication channels, including but not limited to WhatsApp and SMS.
- The Platform may automatically retry delivery using alternative channels
- An invitation is considered processed once it has been successfully submitted to at least one communication provider for delivery, regardless of final delivery outcome
Uns does not guarantee, and disclaims all liability for:
- Delivery success or failure
- Message visibility or receipt
- Recipient interaction, response, or attendance
9. Payments & Credits
- Users purchase credits to use Platform services
- Credits are consumed when an invitation is processed for delivery, including but not limited to initial attempts and retries
- Credits are non-transferable and have no cash value except where required by applicable law
- Credits may be modified, restricted, or discontinued at the Platform’s discretion
- All prices may be subject to applicable taxes and fees, including but not limited to VAT, where required by law
10. Refund Policy
10.0 Nature of Service
The Platform provides digital services that are considered consumed upon initiation of the invitation processing.
10.1 Credit Restoration
Credits may be restored only in cases where the Platform fails to initiate delivery due to an internal technical issue, including but not limited to system errors preventing any delivery attempt.
10.2 No Refund Cases
Refunds, whether in credits or monetary form, will not be provided for:
- Errors resulting from user-provided information, including but not limited to incorrect, incomplete, or invalid recipient details
- Recipient non-response, rejection, or inaction
- Failures, restrictions, or filtering by third-party providers, including but not limited to WhatsApp or SMS carriers
- Successfully processed invitations
10.3 Monetary Refunds
Monetary refunds are not guaranteed and may be granted at the Platform’s discretion, except where required by applicable law, in exceptional circumstances including but not limited to duplicate charges or verified billing errors.
10.4 Refund Processing Time
Any approved monetary refunds will be processed within a reasonable period, not exceeding 14 business days, subject to payment provider timelines.
10.5 Support & Inquiries
Users may contact support for billing or refund inquiries via the contact details provided in this Policy.
11. Third-Party Services
The Platform relies on third-party services, including but not limited to messaging providers and payment processors.
Uns disclaims all liability arising from:
- Service outages
- Delivery failures
- Restrictions or limitations imposed by such third parties
12. Prohibited Use
You may not use the Platform for:
- Spam, abuse, or unsolicited communications
- Impersonation or deceptive practices
- Illegal, harmful, or fraudulent activities
- Any activity that may harm the Platform, its users, or third-party services
Uns reserves the right to suspend, restrict, or terminate accounts, including but not limited to cases of suspected abuse, high failure rates, or violation of these Terms.
13. No Endorsement
Uns does not endorse, verify, or guarantee any event, invitation, user, or content on the Platform.
14. Limitation of Liability
To the maximum extent permitted by law, Uns shall not be liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to:
- Event-related issues or disputes
- Loss of data, revenue, or business
- Delivery failures or communication issues
- Actions or omissions of users, guests, or third parties
15. Indemnification
You agree to indemnify and hold harmless Uns and Takamul Technologies from and against any claims, damages, losses, liabilities, and expenses, including but not limited to legal fees, arising out of or related to:
- Your use of the Platform
- Your content or invitations
- Your violation of these Terms
16. Termination
Uns may suspend or terminate your access at any time, including but not limited to:
- Violation of these Terms
- Risk to Platform integrity
- Legal or regulatory requirements
17. Governing Law & Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of the Kingdom of Saudi Arabia.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in the Kingdom of Saudi Arabia.
18. Mobile Application & Store Compliance
18.1 Apple App Store
If you access the Platform via an application distributed through the Apple App Store:
- These Terms are concluded between you and Uns, not Apple Inc.
- Apple Inc. is not responsible for the Platform, including but not limited to its content, functionality, or support
- Apple Inc. has no obligation to provide maintenance or support services
- Apple Inc. is not responsible for addressing any claims, including but not limited to product liability, legal compliance, or intellectual property claims
18.2 Google Play
If you access the Platform via an application distributed through Google Play:
- These Terms are between you and Uns, not Google LLC
- Google LLC is not responsible for the Platform or its content
- Your use of the application must comply with applicable Google Play policies
18.3 In-App Purchases & Payments
- Purchases may be subject to platform provider terms and fees
- Uns is not responsible for additional charges imposed by such providers, including but not limited to commissions or transaction fees
18.4 External Payments
- The Platform may redirect to external payment environments
- Uns is not responsible for their availability, security, or performance
19. Messaging & Communication Compliance
19.1 Third-Party Messaging Services
The Platform utilizes third-party messaging services, including but not limited to WhatsApp and SMS carriers.
You acknowledge that:
- These services are operated by independent third parties
- Their policies, limitations, and restrictions apply
19.2 User Consent & Responsibility
You represent and warrant that:
- You have obtained all necessary consents from recipients prior to sending invitations
- You will not send unsolicited, unauthorized, or unlawful communications
19.3 Delivery Limitations
You acknowledge and accept that:
- Messages may be blocked, delayed, filtered, or not delivered
- Providers may impose restrictions based on content, frequency, or recipient behavior
Uns disclaims all liability arising from such limitations.
19.4 Compliance with Provider Policies
You agree to comply with all applicable third-party messaging policies, including but not limited to Meta policies.
Failure to comply may result in:
- Message blocking
- Account suspension
- Termination
19.5 Platform Enforcement
Uns reserves the right to:
- Monitor usage patterns
- Apply rate limiting, throttling, or delivery restrictions
- Restrict or suspend accounts
- Limit messaging capabilities
19.6 No Guarantee of Messaging Quality
Uns does not guarantee:
- Delivery rates
- Messaging performance
- Continued access to communication channels
20. Disclaimer of Warranties
The Platform is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to:
- Availability or uninterrupted operation
- Accuracy or reliability of content
- Delivery success or performance
- Fitness for a particular purpose
21. Service Changes
Uns reserves the right to modify, suspend, or discontinue any part of the Platform at any time, including but not limited to features, pricing, or communication channels, without prior notice.
22. Force Majeure
Uns shall not be liable for any failure or delay resulting from events beyond its reasonable control, including but not limited to:
- Third-party service outages
- Network failures
- Government actions
- Natural events
